INTERNeX Terms and Conditions

Program Policies

These Terms and Conditions are part of the agreement between you the participant (‘you’ or ‘your’) and INTERNeX international exchange Ltd. (‘we’ or ‘us’) and Overseas Work Experience Limited operating under Internex World (hereafter referred to as INTERNeX). These terms and conditions concern the usage of all services provided by INTERNeX including the usage of our website. You hereby agree that you have read and understood what is explained above and mentioned below. You acknowledge that accepting these Terms and Conditions by ticking the box below forms a part of the application process discussed below.

  1. Application Requirements

1.1 In order to apply for a placement with us, you must be, for the duration of the placement:

  1. between the ages of 18 and 29, 30 or 35 (depending on permit/visa availability of your destination and country of origin) for any placement requiring a work permit and be able to obtain a valid permit for the duration of the placement; or
  2. between the ages 18 and 55 for any other placement.

1.2 Placement means your internship (practicum), ranchstay, work or volunteer placement.

1.3 You must apply to INTERNeX using any of our available online, digital or paper application options or applications from an INTERNeX agent or University partner approved by INTERNeX (Approved Agent). Hand-written applications will not be accepted.

1.4 Your Application may be submitted online or digitally directly to INTERNeX or by and Approved Agent. Any such Approved Agent is deemed to be an agent of yours.

1.5 In addition to the information required under the Application you are required to submit:

  1. A Copy of the picture page of a valid passport for international travel with at least 18 months validity;
  2. A current CV (resume) in English and correctly formatted;
  3. Letter of Motivation in English;
  4. Employer references (translated into English if required by us);
  5. An up to date criminal background check (if required by program);
  6. 3 photos (1 casual, 1 passport, 1 in appropriate environment pertaining to our placement; e.g. with animals, at work); and
  7. any other documents as requested in the Application and/or the application process at our discretion.

1.6 When submitting the Application, you agree that your personal information as contained in the Application can be held by INTERNeX and shared with third parties in order to consider your Application and to provide you the services as outlined in our Privacy and Management of Personal Information Policy.

1.7 When submitting the Application, you agree to pay the non-refundable application fee and the program fee.

  1. Consideration of Application

2.1 Once we have received your Application in accordance with clause 1 above, we will invite you for an online consultation (this may be via zoom, WhatsApp, Skype or telephone).

2.2 The purpose of the consultation is:

  1. for the placement supervisor to consider your Application (i.e. the placement supervisor will likely ask you questions about your experience and motivations and your qualifications); and
  2. to provide you with opportunity to ask any questions that you may have.

2.3 Following the consultation, the placement supervisor will make a decision whether to accept or deny your Application and will notify you of the decision within a reasonable time period.

2.4 A decision as to whether your Application is accepted is at the complete discretion of the placement supervisor and INTERNeX.

2.5 INTERNeX is not required to provide you with any information in relation to the decision made under clause 2.3.

  1. If your Application is accepted

3.1 If your Application is accepted as per clause 2, we will begin the process of consulting with potential host organisations and families (Placement Providers) to attempt to secure a placement for you.

3.2 Placement Providers may wish to interview you. It is your responsibility to make yourself available for any such interview.

3.3 Placement Providers may at their discretion require further information from you. It is your responsibly to make such information available to the Placement Provider.

3.4 We reserve the right to cancel the search for a placement at any time and pay you the refund according to our refund conditions.

3.5 If we are successful in securing a placement for you will receive:

  1. A confirmation of the placement from the Placement Provider setting out all information pertaining to your placement.

3.6 If you accept the Placement Offer you must pay to INTERNeX the full placement fee in advance for the full period of the placement.

3.7 The Placement Fee is payable within 4 weeks of receiving the Letter of Confirmation and invoice, and no later than 4 weeks before the start of your placement.

3.8 If the Placement Offer is not accepted, adjusted or declined by you within six (6) weeks of the Placement Offer date, the Placement Offer will lapse and a new application will need to be submitted. You will not be entitled to a refund of the Placement Fee if this time period passed.

3.9 We aim to ensure placement opportunities are offered within 4 weeks of the proposed start date, or as agreed in alternative correspondence, if payment has been received in full. On occasion placement opportunities may be delayed and no refund is provided in these circumstances.

  1. Scope of Service 

4.1 While we do our utmost to only work with the best Placement Providers, we have no control or responsibility for these services nor do we make or give any warranty or representation regarding their services.

4.2 We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of Placement Providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the fees paid by you for the placement.

  1. Placement Opportunities

5.2 Placements may be either full or part-time; exact hours vary depending on the individual placement opportunity.

5.1 Specific conditions of Placement cannot be guaranteed in advance.

5.2 Participants must follow host policies, procedures and practices and behave responsibly at all times.

5.3 In some situations, delays with the start date or the timing of certain aspects of a Placement may occur. Such delays may incur costs to which you are responsible.

5.4 Any transgression of our policies, procedures, or practices may result in the immediate termination of your Placement.

5.5 You must conduct yourself in a professional a manner whilst participating in any Placement provided by us. We reserves the right to terminate the Placement where in our opinion, or in the opinion of our servant, agent, client or employee, you are exhibiting behaviour that is likely to cause or is causing disruption, danger or any other injurious interference, including damage to property. If such termination arises, you must vacate the Placement. Our liability to will cease upon termination and we will have no further obligation to you.

  1. Ongoing Support

6.1 Notwithstanding clause 4 above, we will take reasonable steps to support you during your placement and in your interaction with the Placement Provider. This support is provided at the discretion of INTERNeX and no component of your fee is allocated towards this part our services.

6.2 If you experience ongoing issues with your Placement and/or your Placement Provider we may at our complete discretion support you in arranging alternative opportunities.

  1. Risk and Insurance

7.1 If you are travelling to Canada, New Zealand or Australia for your program, medical and travel insurance are required by law. You must take out a comprehensive insurance policy to protect yourself from risks associated with travelling. 

7.2 You must be satisfied that the insurance is sufficient to cover risks, including health care, personal property, travel protection, repatriation etc. It is essential that you understand the insurance policy and that you are aware of the inclusions and exclusions.

7.3 INTERNeX will not be liable for any loss or damage that you incur in the event that the insurance does not provide any or satisfactory cover.

7.4 We are happy to arrange insurance for you. You acknowledge and accepts that INTERNeX will not provide a refund for any insurance product purchased on your behalf.

7.5 You understand and accept that there are risks associated with traveling to and temporarily residing in a foreign country. Such travel involves foreseen and unforeseen risks that are inherently dangerous, all of which are accepted and assumed by you. INTERNeX directors, employees, managers, shareholders, host organisations, host families, service providers, stakeholders or partners are not liable for any loss that you may suffer.

  1. Limitation of liability & Indemnity

8.1 To the maximum extent permitted by law, INTERNeX's total liability arising out of or in connection with its performance of its obligations pursuant to these terms and condition, or arising out of or in connection with the supply of specific services including pursuant to or for breach of these terms and conditions or repudiation thereof, under statute, in equity or for tort, including negligent acts or omissions) is limited as follows:

(a) INTERNeX shall have no liability to you for any consequential loss (Consequential Loss means loss of expected savings, loss of use, loss of opportunity, loss of profit, loss of revenue, increased financing costs, loss arising from delay, or any consequential, special or indirect loss or damage, whether or not the possibility or potential extent of the loss or damage was known or foreseeable, and whether arising from a claim under indemnity, contract, tort (including negligence), statute or otherwise); and

(b) INTERNeX's total aggregate liability for Loss (Loss means any expense, cost or damage of any kind and includes Consequential Loss and a fine or penalty imposed by a statutory or other authority;), however arising, shall not exceed the GST exclusive fees paid by you.

8.2 Each party must take reasonable steps to mitigate any Loss it suffers or incurs.

8.3 You unconditionally agree to fully indemnify INTERNeX and all its servants, agents, clients and employees against any injury, damage or accident that may be sustained by you, whilst participating in the placement and/or associated activities booked through INTERNeX.

  1. Immigration

9.1 It is your responsibility to ensure that you are allowed to be in your chosen country, i.e. Canada, New Zealand or Australia, to undertake your program.

  1. Travel and Documentation

10.1 We do not arrange any flights to Canada, New Zealand or Australia and these are entirely your responsibility and at your own cost. If you are travelling to Canada, Australia or New Zealand for one of our programs you must inform us at least 14 days prior to arrival with complete flight details from your travel agent or airline. Without these we cannot make any service bookings on your behalf if these have been booked. No refunds for missing services are possible if we have not received your flight arrival details.

10.2 You are responsible to carry all required documentation to enter the country as specified by Immigration.

  1. Privacy

INTERNeX and the participant agree to the conditions of the Privacy Policy

  1. Versions

11.1 The definitive version of these conditions are located on our website 

11.2 You accept that any translations of our terms and conditions are provided for convenience only. Where there is a different meaning in interpretation of translation, the most recent English language version shall apply

  1. Force Majeure

12.1 INTERNeX has no liability for any lack of performance, unavailability or failure of the services or its website, or for any failure of INTERNeX to comply with these terms and conditions, where the same arises from any cause reasonably beyond the control of INTERNeX

13. Governing Law

These terms and conditions and the services provided are governed by the laws of your destination country, i.e. Canada, New Zealand or Australia, and the jurisdiction of the local, regional, provincial or municipal courts.

14. Enforceability

If any of the terms and conditions are found to be void, voidable or unenforceable, then that part of these terms and conditions shall be severed from, and will not affect or derogate from, the validity and enforceability of the remaining provisions of, these terms and conditions.

15. No amendments

No amendment or variation of these terms and conditions is valid or binding on a party unless made in writing and executed by the parties.

Payment and Refund Policies

Practicum/Internship Program fees

1. Each program fee entitles a candidate to a single placement.

2. Candidates are required to pay the application fee at the time application is submitted.

3. Before INTERNeX will begin working on a candidates file, the remaining payment must be paid in full.

4. Placement opportunities will be offered within 12 weeks of the proposed start date if payment has been made.

5. After a candidate has been accepted, if they wish to cancel,

INTERNeX will withhold a portion of fees as follows.

- After application: application fee 

- After INTERNeX consultation arranged: application fee + 25% of remaining program fees.

- After INTERNeX consultation completed: application fee + 50% of remaining program fees.

- After host interview arranged: application fee + 75% of remaining program fees

- After placement opportunity offered: No refund

6. In the following cases a candidate will receive no refund:

- If a candidate misses two scheduled host interviews without a valid reason (i.e. doctor’s note or 48 hours notice).

- A candidate cancels their program without a valid reason after they have started their placement.

- A placement is cancelled by the host for cause or due to candidate misconduct.

- A candidate misrepresents themselves, breaks any laws or harms the reputation of INTERNeX or the host.

Hospitality City and Resort Program fees

1. Each program fee entitles a participant to INTERNeX support services outlined in the Program Manual until a placement opportunity is secured by the participant.

2. Placements may be secured by a participant completely on their own or through INTERNeX’s recommendations.

3. Participants are required to pay the application fee at the time application is submitted.

4. Before INTERNeX will begin working on a participants file, the remaining payment must be paid in full.

5. Recommendations for placement opportunities will be made within 12 weeks of the start date if payment has been made.

6. After a participant has been accepted, if they wish to cancel,

INTERNeX will withhold a portion of fees as follows.

- After application: application fee

- After INTERNeX consultation arranged: application fee + 25% of remaining program fees.

- After INTERNeX consultation completed: application fee + 50% of remaining program fees.

- After arrival, safety, and program orientation: application fee + 75% of remaining program fees

- After local company-specific orientation: No refund

Volunteer Program fees

1. Participants are required to pay the application fee at the time application is submitted.

2. Before INTERNeX will begin working on a participants file, the remaining payment must be paid in full.

3. After a participant has been accepted, if they wish to cancel,

INTERNeX will withhold a portion of fees as follows.

- 2 or less weeks after application: application fee

- 12+ weeks prior to proposed start: application fee + 25% of remaining program fees.

- Less than 12 weeks prior to proposed start: application fee + 50% of remaining program fees.

- After volunteer opportunity offered: No refund

Ranchstay/Farmstay Program fees

1. Participants are required to pay the application fee at the time application is submitted.

2. Before INTERNeX will begin working on a participants file, the remaining payment must be paid in full.

3. After a participant has been accepted, if they wish to cancel, INTERNeX will withhold a portion of fees as follows.

- 2 or less weeks after application: application fee

- 12+ weeks prior to proposed start: application fee + 25% of remaining program fees.

- Less than 12 weeks prior to proposed start: application fee + 50% of remaining program fees.

- After opportunity offered: No refund

4. Ranchstay weekly fees are due in full for the whole period of stay at the time placement fees are paid.

5. Participants are required to give 30 days written notice of early departure to be eligible for a refund of additional fees.

Homestay fees

1. Homestay application fee is required at the time of application.

2. Remaining Homestay fees are due in full for the whole period of stay at the time placement fees are paid.

3. Participants are required to give 28 days written notice of early departure to be eligible for a refund of additional fees.

4. Participants with special dietary needs may need to purchase extra food 

Other fees

1. INTERNeX is not responsible for refunds from any third parties that participants may be involved with during their time on an

INTERNeX program; including:

• Immigration or any government fees

• Airfares or other travel or tour bookings

• Hostel, hotel, or staff accommodation bookings

• Insurance policy or any incurred medical-related fees

2. INTERNeX is not responsible for any additional costs related to the completion of a placement including:

• International, national or regional travel requirements

• Staff uniforms, shoes or other equipment

• Additional insurance (including medical) requirements

• Union or other costs related to the host organization
